Terms of Use

This page, together with the documents referred to on it, tells you the terms on which you may make use of this site or system (the Site), and any interactive services on it, whether as a guest or a registered user. Please read these Terms of Use carefully before you start to use the Site. By using the Site, you accept these Terms of Use (including as amended and updated from time to time) and you agree to abide by them. If you do not agree to these Terms of Use, please cease using the Site immediately.

INFORMATION ABOUT US

The Site is operated by the International Transport Workers’ Federation (the ITF). The ITF is a global union federation. Its secretariat is based at ITF House, 49-60 Borough Road, London SE1 1DR. The ITF is registered with the United Kingdom Certification Office for Trade Unions and Employers’ Associations. 

ACCESSING THE SITE

Access to the Site is permitted on a temporary basis and the ITF reserves the right to withdraw, suspend, discontinue or amend the service it provides on the Site without notice.  The ITF will not be liable if for any reason the Site, or any content on it, is unavailable at any time or for any period. From time to time, the ITF may restrict access to some parts of the Site or the entire Site to registered users.
 
If you choose or you are provided with a user identification code, password or any other piece of information as part of the ITF’s security procedures, you must treat such information as confidential and you must not disclose it to any third party. The ITF has the right to disable any user identification code or password whether chosen by you or allocated by the ITF at any time if in its opinion you have failed to comply with any of the provisions of these Terms of Use.

USE OF THE SITE

When using the Site, you must comply with the provisions of the Acceptable Use Policy.

In no event will the ITF be liable for any damages including without limitation direct indirect or consequential damages or any damages whatsoever arising out of or in connection with the use of or loss of use of any part of or any material on the Site and regional urls including downloads whether pursuant to an action based on contract, tort or any other basis.        

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the Site and in the content published on it are owned by or licensed to the ITF or otherwise used by or licensed to the ITF as permitted by applicable law.  Those works are protected by copyright laws, other intellectual property rights, and treaties around the world. All such rights are reserved.

You may not change or modify any material on this Site whether in hard copy or electronic format.  

You may not frame the material on this Site onto any other website without the express permission of the ITF.

You may not use or distribute any material on this Site for commercial exploitation. Material on this Site may be used and distributed by you for personal and/or non-commercial purposes which are lawful, in compliance with the Acceptable Use Policy, and in support of trade union activities and/or ITF objectives, provided the ITF/this Site is acknowledged as the source of the material.

IMPORTANT. This permission DOES NOT APPLY to material supplied by third parties with the strict exception of Content submitted by users of the Site in the following sections of the Site: Comments and Videos which you may use, store, copy, distribute and make available to third parties for personal and/or non-commercial purposes which are lawful, in compliance with the Acceptable Use Policy, and in support of trade union activities and/or ITF objectives. For permitted use of any other third party material on the Site, or for any other purposes, apply to the relevant owner of the material.

RELIANCE ON INFORMATION POSTED

Information on the Site is not intended to amount to advice and is provided without any guarantees, conditions or warranties of any kind, either express or implied. To the extent permitted by law, the ITF, its officers, employees and representatives hereby exclude responsibility and liability (express or implied, contractual, tortious or otherwise) for any material displayed or contributed to the Site including the quality, accuracy, completeness, correctness or timeliness of such information.
 
Except as otherwise stated, any listing on the Site, be it actual text or hyperlink, is not necessarily meant to imply nor should the same be construed as an official endorsement on the part of the ITF. 

LINKS TO OTHER SITES

Links to external websites are provided for your convenience only. The ITF makes no representations whatsoever about any other website which you may access through this Site.  Further, the ITF accepts no responsibility or liability for either the content or the upkeep of any linked third party website, nor the use of personal data by such third party.

A link to a non-ITF website does not necessarily mean that the ITF endorses the content or the use of such websites. The ITF shall not be held responsible for the validity of any of the links and it is your responsibility to ensure that whatever you select for your use is free of such items as viruses, worms and other items of a destructive nature.

INTERRUPTION TO SERVICE

The ITF makes every effort to ensure that the quality of the Site remains high. However, in the context of the global Internet information sent via the Site will pass over public telecommunications networks. The ITF does not warrant that the functions contained in the material contained in the Site will be secure, uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses, bugs or other technologically harmful material or represents the full functionality, accuracy and reliability of the materials. As a result, the ITF does not accept any ongoing obligation, liability or responsibility in respect of the same.

SUBMISSION OF CONTENT

If you submit any material to the Site including without limitation any text, graphics, video or audio (Content), or make contact with other users of the Site, you must comply with our Acceptable Use Policy. You warrant that any Content does comply with those standards, and you indemnify us for any breach of that warranty. This means you will be responsible to us for any loss or damage we suffer as a result of your breach of warranty. The ITF reserves the right to remove any Content if in its opinion such material does not comply with our Acceptable Use Policy. The ITF has the right to disclose your identity to any third party who is viewing any content posted or uploaded by you to our Site that constitutes a violation of their rights. We will not be responsible or liable to any third party for the content or accuracy of any content posted by you or any other user of our Site. The views expressed by other users on our Site do not represent our views or values.  

Any Content you submit to the Site will be considered non-confidential save that if Content is submitted to a password-protected area of this Site, the ITF will make reasonable efforts to keep that Content confidential.

Any Content you submit to the Site will be considered non-proprietary and by such submission, you grant the ITF a worldwide, royalty-free, perpetual, transferable licence to use, store and copy that Content (or derivative works including the Content) and to distribute and make it available to third parties in connection with the service provided by the Site and across different media, and/or to promote the Site, the ITF, ITF objectives and/or trade union activities. You also grant other users of the Site a worldwide, royalty-free, perpetual, transferable licence to use, store, copy, distribute and make available to third parties such Content for personal and/or non-commercial purposes which are lawful, in compliance with the Acceptable Use Policy, and in support of trade union activities and/or ITF objectives.

If you do not wish to grant such rights to the ITF and other users of the Site, it is suggested that you do not submit your Content to the Site.  

PRIVACY

The ITF processes information about you in accordance with its Privacy Policy. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate.

INDEMNITY

You agree on demand to indemnify, defend and hold harmless the ITF from and against any claims, damages, losses, liabilities, and all costs and expenses of defence arising out of or in relation to: your breach of these Terms of Use; or any claim that is based on your use of the Site, your submission or dissemination of any of the information in the Site or content in the Site. You will cooperate as fully and as reasonably required in the ITF’s defence of any claim.  The ITF reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any matter without the written consent of the ITF.

LAW AND JURISDICTION

These Terms of Use are governed by English law. The English courts will have exclusive jurisdiction over any claim or dispute arising out of or in connection with the use of the Site.   You are solely responsible for ensuring compliance with your local laws while using the Site and the materials contained in the Site.

VARIATIONS

The ITF reserves the right to amend these Terms of Use at any time by posting changes online. You agree to be bound by such amendments from the date on which they are posted on the Site. If you cannot accept such amendments, you may notify the ITF and cease using the Site. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on the Site.

If a court holds any of the Terms of Use to be illegal, invalid or unenforceable, the rest of the Terms of Use shall remain in full force.
