Legitimate leadership reinstated at Costa Rica dockers’ union

The supreme constitutional court of justice in Costa Rica has ordered the immediate reinstatement of the legitimate executive board of the dockers’ union Sindicato de Trabajadores de JAPDEVA (SINTRAJAP). It also declared void all agreements brokered by the government-appointed representative Douglas Brenes.
The court ordered on 25 August that the board, including ousted general secretary Ronaldo Blear, be reinstated and declared that collective bargaining agreements and agreements regarding concessioning of the ports of Moin and Limon to private interests, settled by Brenes, were invalid.
In March 2008, Oscar Arias’s government announced plans to privatise the ports in Limón province, putting thousands of dockers’ jobs at risk; the union, rejected the plans. As a result, in January 2010, Arias, along with other ministers and the president of the port administration and development board, Junta Administrativa Portuaria de Desarrollo de la Vertiente Atlántica (JAPDEVA), replaced the legitimate SINTRAJAP union leadership with a “sham” executive board led by Brenes, reportedly to help facilitate the privatisation process.
Antonio Fritz, ITF Americas regional secretary, commented: "It is shameful to see someone who was elected to uphold the constitution of a country lead an organised scheme to violate it. Fortunately the decision of the supreme court and national congress debates show that there are some honest institutions. We can also observe that part of the national press is independent of political interference."
Blear affirmed: "We always stated that we were in favour of modernising the port and even submitted a plan with our own resources to maintain state ownership. It is impossible to privatise the ports by violating the law because this is undemocratic. That’s why we are initiating proceedings against public officials who have tried to seize the port, including former president Oscar Arias and his brother Rodrigo Arias, presidential minister."
