FIT CISL vs Ryanair.


On 12th March 2008, the expected confrontation between the leaders of the Fit Cisl union and Ryanair took place in the meeting room of the Royal Santine hotel in Rome.

We wish to express our absolute dissatisfaction with the result of this meeting, having been faced from the first moment with the company’s arrogant attitude and with total blockage both on the dispute on the matters referred to in the ruling by the Court of Velletri and with regard to the desire to start a new phase associated with dialogue with the union.

On the agenda was the Court’s ruling that provided for a discussion on the contracts of employment existing with Ryanair, on the legislation regarding strikes and on the immediate switching off of the CCTV cameras that had been arbitrarily installed inside the crews’ centre.

We received no credible or concrete responses on these subjects.

By contrast, our delegation did what it could to put the past behind it and to start to lay the foundations for the Ryanair Flight Assistants also to have proper Union Representation in addition, of course, to employment contracts that observe Italian legislation.

In view of the company’s attitude, the National Secretariat of Fit Cisl stressed to the Ryanair delegation that it would reserve the right to respond to any initiative considered appropriate to oblige the company to immediately observe the authority of Community legislation relating to the secondment of staff.

Let us recall that the Flight Assistants are employed with various types of contracts. The “older” ones were employed directly by Ryanair but the “younger” ones work through various temporary agencies such as Work Force International, Crew Link etc.

For all these, only the Irish legislation applies, so (only by way of an example) pension contributions in Italy are not made, despite the fact that very many of these workers have been working in our country for over two years.

But critical issues are to be found everywhere, in every aspect relating to the area of work.

This is why our Organisation has decided to act immediately within a professional framework, which has right from the start shown itself to be very difficult to implement. But the challenge has only just begun.

Our Union Organisation’s objective is to expand its representation within Ryanair and to assure work for the future for the Italian workers based at Bergamo, Pisa and Ciampino airports.

Let us recall that the inspection being carried out by the Direzione Generale Servizi Ispettivi (Office of the Director General of Inspection Services) of Rome and Bergamo are still continuing on the way in which the secondments of the employees on our territory are controlled, on their pension insurance and also on the request submitted to ENAC that, the rules provided in the ENAC FTL regulations and in the associated explanatory Circular OPV-20 are also applied to the Ryanair FAs.

We once more express our utmost solidarity with our Ryanair Flight Assistant friends and colleagues and once more state that we will always be there at Ciampino to inform them of the developments regarding these initiatives that no-one will now be able to stop.

To summarise, Fit Cisl has initiated a global strategy that includes both union-related matters and purely legal ones.

Our objective is to bring an end to the indiscriminate exploitation of hundreds of employees, to give them legal instruments such as a contract of employment and, WE EMPHASISE, to limit the effects of an evil dumping process on all the workers in the Italian Sector who in very many cases are already suffering from the lack of a standard national contract.

It was specifically declared at the end of the meeting that there was the desire to implement as soon as possible the work of the European Works Councils and a specific meeting will very shortly be held at the Brussels headquarters.

At the end of the meeting Fit Cisl declared that it was absolutely dissatisfied and of course it reserved the right to involve the Labour Court again.
