Settlement reached in Viking case
5 March 2008
The ITF, Viking Line and the Finnish Seamen’s Union (FSU) have announced that a negotiated settlement has been reached by all three parties involved in a dispute over the right of trade union members to take industrial action to prevent the reflagging of a vessel.
A statement released on 3 March declared: “Viking Line Abp, the International Transport Workers’ Federation and the Finnish Seamens’ Union have today agreed to settle their dispute as to the right of the ITF and FSU to take industrial action and/or to persuade others to take industrial action to deter the reflagging of the vessel ‘Rosella’ from the Finnish flag to the Estonian or other flag of a Member State of the European Communities and to prevent Viking from negotiating rates of pay and crew conditions other than with the FSU.”
The settlement means that all legal proceedings relating to the dispute have been discontinued.
The issue became the subject of legal proceedings in Finland and later in the UK as well as in the European Court of Justice in Luxembourg. During these proceeding Viking sought declaratory and injunctive relief and damages against the ITF and FSU.
