The Turkish labour ministry has found that UPS acted unfairly when the company dismissed a worker without severance pay.

The Istanbul regional office of the labour ministry was investigating the case of Birol Gündüz, a UPS worker and trade union member, who was requesting that severance be paid to him. He was dismissed on 13 May. The ministry concluded that he had been sacked without “just cause” and was legally entitled to receive the payment; he could apply to the company to receive it. If UPS failed to make the payment, the ministry stated, Gündüz had the right to take the matter to an industrial relations court.

This decision sets a strong precedent for other investigations into the dismissal of UPS workers for their union activity.

The number of dismissed UPS employees in Turkey now stands at over 130 after a further 13 workers were sacked in late July; they are being replaced with new subcontracted workers.

Mac Urata, ITF inland transport section secretary, said: "The ITF welcomes this decision. It reinforces our view that all these recent dismissals have been conducted in a very unfair labour practice environment. We hope that all the other cases will be concluded in the same way."
