US union settles DHL lawsuit

A pilots’ union representing workers at Astar, a DHL air cargo contractor based in the US, has reached an agreement, settling a lawsuit brought by the union against DHL.

The agreement brokered between the Air Line Pilots Association International (Alpa) and DHL means that all Astar pilots employed before March 2008 will be kept on the payroll at least until March 2010.

The deal sees DHL agree to honour a “no furlough” clause in the pilots’ existing contract, which was signed between Alpa and Astar in March 2008. The settlement also secures the pay status of every protected pilot through to March 2010 or for six months after they stop flying, whichever is longer.

The union filed a lawsuit against the company last year for breach of contract and fraudulent inducement. The move was prompted by DHL’s plans to transfer its North American air cargo operations from Astar to UPS; the plans were announced a year ago this week. Alpa opposed the plan from the outset and its executive council and board authorised a grant to fight the proposals through an aggressive public outreach campaign.

“Our goals were simple,” said Captain Pat Walsh, Astar Master Executive Council chair. “Stop the DHL/UPS agreement from being finalised, keep as many of our pilots working as long as possible, and obtain the best severance we could for any pilots who would lose their jobs. None of this could have been achieved without our Alpa contract, our Alpa representation, and our active pilot group.”
