The ex-cabin crew, who were sacked in 2002 after their year’s probation (which in itself is twice as long as the Belgian limit of 6 months) won their case on the grounds that although they had signed Irish contracts, their place of work was Belgium and thus Belgian Laws should apply.

“It (the court) ruled that it was competent in this matter but it considered the working place, i.e. the place where the employees start working, was the airport of Charleroi,” said Christine De Greef, a legal specialist at a Belgian union.

Ryanair has said it would appeal against the tribunal’s decision if it was found in favour of the employees, arguing that the dismissal of the employees was legal under Irish law.

This case is extremely timely as it comes as an EU summit in Brussels is being held to discuss the implications of cross-border employment.
